By purchasing any Products or Services from our website www.diseñistico.com (hereinafter the "Website") and/or using or accessing the information displayed therein, you agree to have studied and understood all of the terms and conditions of service described herein (hereinafter "Terms and Conditions") such as, but not limited to, conditions of use, means for notices and disclaimers; and he agrees with each of them.
Diseñístico with its trade name, provides you with the services of this Website, subject to the Terms and Conditions included herein and in our Privacy and Informed Consent Policy. Therefore, please read these documents carefully and if you have any questions regarding them, you can write to disenistico@gmail.com.
You agree to follow the instructions for the correct use of the Site and, therefore, of the services offered therein. If you do not agree to these Terms and Conditions, please do not access or use the site www.diseñistico.com its material, information and/or services offered hereby.
The Terms and Conditions of the Service, as well as our Privacy and Informed Consent Policy may be modified at any time in the future. For this reason, the use of the services of www.disenistico.com at a time after the realization of these modifications, implies that the User accepts them. It is the User's obligation to be aware of any change or modification in order to study it prior to the new use of the Website and/or its services.
The website www.diseñistico.com is operated by its owner Sofía Alpízar Baltodano, ID 11425816, with the trade name Diseñístico, with the email disenistico@gmail.com and production workshop, domiciled in San Isidro de Heredia, San José, Santa Elena, 125m east of the plaza.
In order to use some of the Services provided by Diseñístico through the site www.disenistico.com, the person may have to register (hereinafter "Registered User"). In other cases, the person may access the Services without being registered (hereinafter "Visiting User"). However, any person who wishes to use the Services must be of legal age in accordance with Costa Rican law (18 years old), must have legal capacity to contract, must provide the information required to provide the Services and must declare that they have read, understood and accepted the Terms and Conditions of the service, as well as our Privacy and Informed Consent Policy.
Registered Users and Visiting Users may be referred to collectively and for as applicable to both equally, as the "User").
Diseñístico will require, for the purposes of creating the Registered User's account, at least the following information: name, surname, email, telephone number, exact address, username under which the User will participate in the Website, as well as any other data that may be requested by Diseñístico for the purposes of providing the Service. The User's email address will be the Registered User ID for the purpose of accessing Diseñístico. For this reason, it will not be possible to change the email address of the account.
Users must provide truthful and accurate information and guarantee that the data they provide is sufficient to be identified and/or located. Any inaccuracy that prevents the identification or location of the User, as well as any false information provided, will entitle Diseñístico to proceed with the cancellation of the Services and the immediate deletion of the account, in the case of Registered Users.
Diseñístico may proceed to close the Registered User's account at its sole discretion, for which it should only communicate such decision to the email address indicated by the Registered User in his/her personal data.
Browsing in certain sections of our Website may or may not, at the sole discretion of Diseñístico, be conditional on the User's prior registration as a Registered User.
2. About the Services
The services offered by Diseñístico on its website www.disenistico.com are the following (for the purposes of this document the "Services"):
Buying Products Online: Through the Website, the User may purchase Diseñístico's own Products or from various suppliers.
Information: Diseñístico may make communications regarding its Products and/or the store, about purchases made by the User, as well as any other communication or display of information that Diseñístico deems relevant, at its sole discretion.
Limitations and exclusions to the Services: Product description and photography. The photographs of the Products offered on the Website display the actual colors corresponding to the Products. However, the colors that the User will see when accessing the Website will depend on the calibration of their monitor. Therefore, we cannot guarantee that the colors displayed on each User's monitor will be identical to those of the Product. It is also essential that the User carefully reads the descriptions and technical data sheets of the products as well as the conditions of purchase before placing the order. This, in order to clearly understand the terms, conditions and restrictions that may apply to each product.
Product Stock: The User understands and accepts that the possibility of completing the sale of the Product depends on the number of stocks of the Product that is kept in inventory. Prior to confirming the transaction, the customer will be informed about the availability of the required Product units.
3. Return and cancellation policies.
In accordance with the Regulations to the Law for the Promotion of Competition and Effective Defense of the Consumer, the consumer will have a right of withdrawal that may be asserted within 8 business days following receipt of the good. For the purposes of asserting it, the following procedure must be followed:
Product Return Policies.
The User will have a period of eight (8) working days from the moment of receipt of the Product to return their order or part of it, in exercise of their right of withdrawal.
This return must be made in person at the Diseñístico's workshop. In order to be able to make the return, the User must present the invoice and the Product must have all the original labels attached or the seals or packaging of guarantee or security in cases where applicable. The return will not be accepted in those cases in which the Product is found without the original labels or seals or security packaging, with signs of use, or in poor condition.
Due to their nature, the customer may only make returns for the products purchased that are part of the utilitarian furniture catalog. Products from the "CoolHunter" line, internal design consultancies, architectural services, are not part of the return policy, at a discount or expressly indicated on the Website as not subject to returns.
The customer must take the product to the facilities of Diseñístico, where the condition of the product will be assessed, it will be verified that it is in perfect condition, the legs are not scratched, misadjusted, dirty, or have bumps. The corners of the furniture are not hit, the envelopes do not have cut marks, wear caused by misuse or stained, with food remains, marks, hair or animal urine.
The refund will be made to the same means by which the payment was received to make the purchase within 30 calendar days, once there is the approval by email with the purchase invoice and it is verified that the furniture is in perfect condition. The return time of the product will be by appointment indicated by Diseñístico.
In case of making a return and the product has been delivered to your home, the refund of the transport service is not made since it was made in the time established and coordinated by the customer. The customer must return the product to our workshop located at the address indicated on the Diseñístico website during daytime working hours from Monday to Friday or on Saturdays from 8am to 12pm.
Custom-made furniture is not returned as it is previously checked with the customer by means of a quote, technical sheet, plans or diagrams, sample review and previous visits.
Diseñístico will charge 5% of the value of the product corresponding to administrative charges when return policies are made, cancellation of orders.
Cancellation Policies.
The cancellation policy applies only to products from the utility catalog or the "Cool Hunter" line. If the customer wishes, they can cancel within a period of no more than 24 hours after the purchase has been made.
You must inform Diseñístico of your decision by email to disenistico@gmail.com justifying the reasons for cancellation. If the customer wishes to cancel their order after the indicated period, the return policy applies, respecting the points described above.
If the payment is made by credit or debit card, the money will be refunded within 5 business days, applying a 5% discount corresponding to administrative fees. If the payment was made by transfer, outside the platform, you must send via email, the transfer receipt, to proceed with the refund process in approximately 3 business days.
4. Prices and payment method.
The prices of the Products displayed are indicated in colones, legal tender in Costa Rica, and with all taxes included. Any other costs associated with the purchase, such as, but not limited to, shipping services, gift wrapping services, or any other costs that you may offer to your Diseñístico's Users in your sole discretion, will be charged separately and will be indicated on the purchase order to be cancelled.
The User may make payment for their orders online by means of their credit cards. Such payment must be credited prior to shipment of the Product. The User undertakes not to charge the card.
At the end of the online purchase process, the User will always receive a confirmation of the purchase and a confirmation from the payment processor to their registered email. The digital invoice for the purchase will be sent by the same means.
It is essential, for the purposes of making the purchase, that the User verifies all the data on the items they wish to purchase in order not to make mistakes, that they properly insert all the information required for the delivery of the Product, and that they understand and accept the terms and conditions of purchase.
Diseñístico will not be responsible for problems derived from failures in the system of the payment processor and/or the bank through which the payment is intended to be made, in which case the User must contact their service provider to correct the problem and be able to make the purchase in question.

5. Shipping and receiving the order.
The freight and/or delivery services of Products will be carried out only in the territory of Costa Rica and in the areas indicated in the section, unless Diseñístico undertakes to do otherwise in a particular case.
Prior to confirming the order, Diseñístico will inform the User about the availability of delivery services in the required territory.
Shipping costs, as well as any other costs related to the order, will be paid together with the final amount of the order. Shipping costs will be borne by the User and will be calculated in accordance with the delivery destination and the number of units, weight and dimensions of the Products purchased. Shipping costs will be detailed throughout the purchase process and the buyer will have the possibility to review and approve the total cost before finalizing their purchase.
Delivery of orders will be made to the delivery address freely designated by the User within the Territory and within the established Delivery Period. Diseñístico will not assume any responsibility when the delivery of the Product cannot be executed as a result of the inaccuracy or falsehood of the data provided by the User, due to the absence of the recipient, or for any other cause beyond the responsibility of Diseñístico.
The User shall be responsible for checking the package at the time it is delivered to him/her. This in order to verify that you have received all the Product for which you paid and that it is delivered in good condition. You must also sign the receipt of the Product. If for any reason the Product received is incomplete or damaged, the User should not receive the package and must notify Diseñístico about the situation so that Diseñístico can investigate the situation and resolve the problem. The Product must be received by the User or by a person of legal age.
The User releases Diseñístico from all liability in relation to possible transactions that could not be completed for reasons beyond the control of Diseñístico.
Furniture is dispatched within 5-10 business days once the customer receives confirmation of their purchase for furniture from the utility product catalog. Custom-made furniture has a delivery time of 10 to 22 working days once payment has been made.
In the event that a product is available for immediate delivery and the customer wishes to pick it up either the same day or once it is ready for delivery in Diseñístico, it must be coordinated directly through the defined means of communication.
If the customer wishes to review the quality of the product prior to making purchases through the website, they may visit the physical facilities of Diseñístico at the established times to proceed later to make their purchase.
For home deliveries, transportation is calculated based on the current Diseñístico's tariff, calculated by type of transportation (truck, light load, vehicle or motorcycle depending on the size of the product) by province, canton, district and exact location. Prices do not include transportation. This is added to the value of the furniture.
Each week, routes are defined as orders are received, therefore the person will be informed of the day and time when the corresponding delivery will be made.
The products of the "Cool Hunter" line that meet the characteristics and suitable packaging, may be sent through Correos de Costa Rica to the branch that the USER specifies. It will be the USER who picks up the product at the indicated branch and it will have a value of 3500 colones. Courier deliveries may be applied that vary according to the weight and established address. (Prices range from 5500 to 15000 colones calculated based on the rates established by Correos de Costa Rica).
The internal design consultancies have a compound term: once the payment has been made, the User has 7 calendar days to send all the ideas, concepts, measurements, plans, videos, photographs, references related to the space they wish to intervene. Diseñístico has 15 calendar days to work on the requested proposal. (If more time is required due to design considerations, it will be communicated in advance to the customer.) Once the proposal is submitted, the client has 7 calendar days to make observations, request corrections and changes that apply based on the proposal. Subsequently, Diseñístico has 7 calendar days to present the final document. In the event that the User does not respond within the indicated periods, the design process is closed, the material is sent in its latest version and the User will be notified. If the User wishes to resume the process, he/she must pay the entire value of the advice again.
6. Account Liability.
In order to make purchases in a more agile manner, as well as to have access to certain content accessible only to Registered Users, the User must register an account, as indicated in clause TWO above. This account will be assigned a username and an access code.
All Users are responsible for maintaining absolute confidentiality about their username and password to access their account in Diseñístico, since it will contain sensitive information. All Users accept responsibility for any illegal or unauthorized activity in accordance with these Terms and Conditions, which is carried out through the use of their registered account with Diseñístico. In this regard, the Registered User undertakes not to allow the use of their account by third parties and, in particular, by minors.
The User releases Diseñístico from all liability for damages or losses occurring as a result of the use of the account by third parties. Likewise, Diseñístico reserves the right to refuse a service request, close an account or cancel orders, at its sole discretion and, in particular, upon suspicion of any irregular activity, the use of an account by third parties outside the account or by minors.
7. Product Warranty.
In the event that the warranty applies to products in the utility catalog, the possibility of replacing the furniture can be considered once the corresponding valuation is made.
When the furniture can receive an adjustment or repair that does not modify its appearance, it does not apply to its replacement, so the corresponding work will be carried out. These will be coordinated based on the availability of both the USER and Diseñístico.
For products of the "CoolHunter" line, these are for final sale, they do not have the possibility of refund or exchange. Diseñístico verifies each product prior to shipment to ensure that it does not present problems or conditions that require subsequent warranty.
In case the custom furniture presents any defect or verified damage, it must be communicated through our authorized means of communication to analyze the case assess and if you have the approval, the change of the product or its repair.
8. Maintenance of the furniture.
Chipboard furniture should be cleaned with a damp cloth without soaking the furniture. It resists high chemical level products such as zinner or turpentine, however, its daily use is not recommended as it accelerates the anticipated wear of the material. On furniture made of solid wood, no polishing product, surface cleaner or lysol is recommended. It should be cleaned with a damp cloth in water so as not to alter the finish and sealing of the wood. Any practice that is not recommended that puts the condition of the furniture at risk will automatically lose the warranty.
Natural stone envelopes must be cured by the customer with transparent wax after installation as an additional protection measure.
9. Communication with the User.
Any User who registers and/or uses the services of Diseñístico and/or who writes to us by e-mail, will receive communications by the same means (the e-mail registered by the User) from Diseñístico.
The User agrees that Diseñístico may communicate by means of the email registered by the User: information about promotions, about Products, invitations to events, notifications about changes to the Terms and Conditions, electronic invoices, order confirmations, as well as any other information or formal notification that Diseñístico needs to communicate to the User.
Therefore, the User is responsible for keeping his/her personal information updated and for periodically checking his/her email.
In the event that the User does not wish to receive certain information to their email, they must indicate it to the following means hello@diseñistico.com. Notwithstanding the foregoing, it is important to note that there is information that Diseñístico must necessarily send to the User to their email, either for the purposes of providing the Service or in order to comply with applicable legislation. If the User does not authorize Diseñístico to send this information, Diseñístico will not be able to provide the Service.
10. Liability in relation to the use of the services.
All Users accept responsibility for any illegal or unauthorized activity in accordance with these Terms and Conditions, which is carried out through the use of the platforms or Services provided by Diseñístico.
The User releases Diseñístico from all liability for damages or losses occurring as a result of the User's misuse or incorrect use of the platforms or Services provided by Diseñístico through the site. Likewise, Diseñístico reserves the right to reject a request for service, at its sole discretion and, in particular, in the event of suspicion of any irregular activity or the use of the Site for purposes other than those provided herein.
Diseñístico may close or restrict the User's access to the Services if any improper use of the Website and/or the services offered therein is detected, including but not limited to, the following cases:
11. Links to other pages and information published by Users or third parties.
Diseñístico may post links to other web pages on your Site. The User expressly accepts that Diseñístico is not responsible for the content of such links or for the veracity or accuracy of the information contained in said links.
Diseñístico may also allow Users or third parties to post links, photographs, comments, ideas, ratings of the Services and/or Products, as well as any other type of information, provided that it is not defamatory, denigrating, libelous, disrespectful, threatening, invasive of privacy, offensive, discriminatory, unfounded, violates intellectual property rights, contains viruses, proselytizing, "spamming" or content that could be considered illegal in any form. Any content of this type or that Diseñístico considers false or made through a false profile, may be removed from the site without having to provide any explanation from Diseñístico.
The User and, in general, any natural or legal person who intends to establish a link from its website to www.diseñistico.com, must obtain prior written authorisation from Diseñístico. The establishment of this link does not imply in any case the existence of a relationship between Diseñístico and the owner or owner of the website on which it is established, nor the acceptance or responsibility of Diseñístico in relation to its contents or services.
12. Intellectual Property Rights.
If a User posts content or material on the Website, unless expressly indicated otherwise by Diseñístico, the User would be granting Ingeniístico a non-exclusive, free and royalty-free, perpetual, irrevocable and fully sublicensable authorization and/or license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display said content throughout the world and in any media, whether tangible or intangible. Likewise, the User authorizes Diseñístico the right to use the name, image, and/or any content that the User submits, uploads or posts to the Website.
The User represents and guarantees that he/she is the owner or that he/she has the necessary rights to the content he/she posts, that the use of the content that the User provides does not infringe any intellectual property rights of third parties and will not cause damage to any person or entity. The User hereby assigns any image and/or voice rights that appear in the content they post. Likewise, the User declares that he exempts Diseñístico from all liability related to the content he posts and that he will indemnify Diseñístico for any claim resulting from the content that the User posts. Diseñístico reserves the right to monitor and edit or remove any activity or content that is posted by the User in its sole discretion. Diseñístico is not responsible for and assumes no responsibility for any content posted by the User or any third party.
The intellectual property rights over the contents of the Website, including but not limited to: its graphic design, ideas, services, the distinctive signs that appear (trademarks and trade names), the underlying computer programs and/or software (including source codes), as well as the different elements that make up the Website (texts, graphics, photographs, videos, etc.) correspond solely and exclusively to Diseñístico.
The use of the Website by the User does not imply in any way that there is an assignment of any intellectual and/or industrial property rights over the Website, its contents and/or the distinctive signs of Diseñístico and/or any of the trademarks displayed on the Site. To this end, the User is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting and/or reusing the website, its contents and/or the distinctive signs of Diseñístico and/or any of the trademarks displayed on the Website.
13. Release of liability
The User acknowledges and accepts that the use of the Website is at all times at his/her own risk and responsibility. Diseñístico will not be responsible for any improper use that may be made of the Website.
Diseñístico will not be responsible for damages of any kind caused to the User's electronic equipment (computer, telephone, tablet, or others) by viruses, worms or any other harmful element. The User acknowledges that the use of the Internet network implies the assumption of a risk that their computer equipment may be affected by the elements listed above. To this end, it is the User's responsibility, in any case, to have adequate tools available for the detection and elimination of harmful electronic programs that may pose a risk to their computer equipment.
Diseñístico will not be responsible for problems arising from failures in the system of the bank through which the payment is intended to be made, in which case the User must contact their service provider to correct the problem and be able to make the purchase in question.
Diseñístico will not be responsible for the failure to perform its obligations when there is force majeure, fortuitous event or the entry into force of government legislation, regulations or restrictions of any other nature that prevent it from performing its obligations.
14. Miscellaneous aspects.
Any doubt or query about the scope and interpretation of these Terms and Conditions may be answered by email disenistico@gmail.com; The response to these queries will not imply a total or partial modification of this document, or a waiver of its compliance.

2. Seguridad: Esta medida es para evitar sustos con el perro guardián, prevenir conflictos con otros perros o niños, y evitar la entrada de ratones en los vehículos.
